Environmental risks are present in many commercial transactions. We counsel clients about contracts and commercial transactions in order to minimize those risks. Day Ketterer attorneys have represented businesses of all sizes to resolve environmental claims with administrative agencies, and state and federal courts. We also work with the client's environmental consultants to minimize environmental assessment and remediation activities throughout Ohio.
Day Ketterer represents clients ranging from the public companies to closely-held business on a variety of environmental matters in state court, federal court, and the Environmental Review Appeals Commission (and its predecessor). In addition, we have resolved a number of matters directly with the Ohio EPA, the Ohio Attorney General's office, the Bureau of Underground Storage Tank Regulation (BUSTR), the United States Environmental Protection Agency and the United States Department of Justice in a variety of environmental matters. These have included permitting, RCRA compliance and closure, Superfund, Brownfields, closure of UST's and AST's. We also have advised clients concerning environmental issues that arise during transactions, such as the purchase and sale of real estate, companies, and other assets. We have also defended dozens of property damage and personal injury claims based on alleged environmental contamination. In virtually every case, millions of dollars of compensatory and punitive damages were sought. Finally, we have handled various cases against insurance companies claiming that they owed defense and coverage to the firm's clients for environmental claims.
