The Proposed Regulation of Private Funds

According to the Managed Funds Association and other industry groups, limitations on investment strategies, restrictions on capital and the use of leverage, transparency/confidentiality concerns and the imposition of increased expense on the misunderstood alternative investments industry may, in effect, pose its own form of systemic risk. Perhaps that is one reason why the pending bills are generally acceptable to the private fund industry. The House and Senate Bills are similar in some respects, but there are also significant differences.

In attracting new money, often an ability to show better performance than most of your competitors is key, but if you don't have that kind of performance, you can partner with someone who does, change the composition of your investment committee or change your investment strategies, or otherwise be aggressive with performance presentation, while remaining within the law.
