Oil & Gas

Thomas E. Hartnett, Chairperson

Day Ketterer's Oil & Gas Practice Group has represented Ohio landowners in all types of transactional matters involving oil and gas leasing. Our attorneys have represented landowners and mineral rights owners in the following areas:

  • Oil and gas lease negotiations
  • Termination of non-productive oil & gas leases
  • Estate planning and wealth management

Day Ketterer strives to put our clients in the best possible position to maximize their financial opportunities from their natural resources. We have the knowledge and experience to understand and advise our clients on oil and gas agreements, as well as prepare title opinions, purchase and sale agreements, and other transactional documents. Additionally, we conduct litigation surrounding transactional and real property issues.

Recent Representative Transactions:

Day Ketterer recently represented a large, non-profit organization which was subject to an oil and gas lease that was producing very little revenues on over 500-acres of property owned by the organization. The client wished to take advantage of the increased up-front fees and royalties arising from the new Utica Shale Play, but was prevented from doing so based upon the exisiting lease. Day Ketterer filed suit on behalf of the client alleging that the well was not producing sufficient paying quantities and that the oil and gas company had breached both express terms of the agreement and implied warranties imputed by Ohio law. As a result of our legal efforts, we were able to have the existing oil and gas lease terminated and our client was able to enter into a new lease with revenues that would substantially impact their operations for the foreseeable future.
