Matasich Obtains Defense Verdict in Retaliatory Discharge Case

Stephen Matasich obtained a defense verdict following a jury trial in a wrongful discharge case before the Stark County Court of Common Pleas.  The plaintiff alleged that her employment was terminated in retaliation for having filed a workers’ compensation claim, and that the employer’s proffered reason for the termination (late post-accident drug screen) was merely a pretext for the retaliation.  However, primarily through a lengthy cross-examination of the plaintiff, Stephen convinced the jury that the plaintiff’s excuse for the untimely post-accident drug screen was not credible, and that the employer appropriately terminated the plaintiff consistent with the drug screen policy.
