Paul B. Hervey

Paul B. Hervey is a Member, practicing primarily in the area of Domestic Relations and Family Law. Mr. Hervey assists clients in a variety of matters including divorce, dissolution, child custody, and child support.  Mr. Hervey has practiced continuously in the Stark County Family Court during his entire career, as well as surrounding counites. His comprehensive domestic relations experience encompasses the basic dissolution of a marriage to multi-million dollar divorce cases successfully defended all the way to the Ohio Supreme Court. He has appeared before the Court of Appeals on more than 50 occasions and has served as a special prosecutor. 

Mr. Hervey resides in Perry Township with his wife, Janice, and their four children.


  • Successfully appealed on behalf of owners of a mineral estate seeking to preserve their interest in a case of first impression.  Wendt v. Dickerson, 147 Ohio St.3d 284, 2016-Ohio-5822, reversing 2014-Ohio-4615 (Fifth District).
  • Successfully represented parent against attempts by non-custodial parent to kidnap child during vacation and seek child support.  See Dazey v. Pollock, 2006-Ohio-4850 (Fifth District).
  • Successfully protected spouse’s interest in business against claims that the assets were pre-marital and subject to an antenuptial agreement.  See Kandel v. Kandel, 130 Ohio St.3d 1419, 2011-Ohio-5605, affirming 2011-Ohio-3031 (Fifth District).
  • Successfully represented petitioner for a civil protection order based upon verbal abuse and threats and defended the appeal of same.  See DiDonato v. Stewart, 2015-Ohio-270 (Fifth District).
  • Successfully represented spouse in arguing that income as well as parenting time can determine which party is a child support obligor.  See McCracken v. McCracken, 2014-Ohio-1411 (Fifth District).
